Complaint/whistleblowing (NEO)

Complaints and whistleblowing reports under Act CLXV of 2013 on complaints and whistleblowing reports may be submitted about the activities of the National Election Office to the President of the National Election Office.

Anyone may submit a complaint or whistleblowing report against an activity of the National Election Office.

Content requirements for submitting a whistleblowing report:

If you do not submit your complaint or whistleblowing report about an activity of the National Election Office to the President of the National Election Office for any reason, the body to which you submit your complaint or whistleblowing report will refer it to the President of the National Election Office within 8 days of its receipt.

The President of the National Election Office will handle the complaint or whistleblowing report within 30 days of its receipt.

If the investigation based on which the complaint or whistleblowing report is handled is expected to take longer than 30 days, the National Election Office informs the author thereof, indicating the expected date of resolution and providing reasons for the extension of the investigation.

No appeal can be made; however, the whistleblower may submit an application to the Commissioner for Fundamental Rights over the information provided by the National Election Office on its investigation of the whistleblowing report if:

 

Based on the application, the Commissioner for Fundamental Rights investigates whether the whistleblowing report was properly considered. If the investigation reveals an irregularity, the Commissioner may make a recommendation to the National Election Office to remedy the irregularity.

 

An application for review may be submitted to the Commissioner for Fundamental Rights as follows:

complaint means a request aimed at redressing a violation of one’s personal rights or interests, provided that it is not handled subject to other, particularly court or administrative, proceedings. A complaint may also include a proposal.

Whistleblowing means drawing attention to a circumstance that needs to be remedied or redressed for the benefit of a community or society as a whole. A whistleblowing report may also include a proposal.

Whistleblowing reports may be made in person at the National Election Office. In such cases, the National Election Office puts the whistleblowing report in writing and provides the whistleblower with a duplicate.
